A tobacco product with a label, labeling, or advertising that uses the descriptor “light,” “mild,” or “low,” or a similar descriptor, is a “modified risk tobacco product” under section 911(b)(2)(A)(ii) of the FD&C Act (21 U.S.C. 387k(b)(2)(A)(ii)). A tobacco product is also considered a “modified risk tobacco product” under section 911(b)(2)(A)(i) of the FD&C Act (21 U.S.C. 387k(b)(2)(A)(i)) if its label, labeling, or advertising explicitly or implicitly represents that (1) the product presents a lower risk of tobacco related disease or is less harmful than one or more other commercially marketed tobacco products (2) the product or its smoke contains a reduced level of a substance or presents a reduced exposure to a substance or (3) the product or its smoke does not contain or is free of a substance. Under section 911(a) of the FD&C Act (21 U.S.C. 387k(a)), no person may introduce or deliver for introduction into interstate commerce any modified risk tobacco product without an FDA order in effect under section 911(g) of the FD&C Act (21 U.S.C. 387k(g)). A product that is in violation of section 911(a) of the FD&C Act (21 U.S.C. 387k(a)) is adulterated under section 902(8) of the FD&C Act (21 U.S.C. 387b(8)). Because the website uses the descriptor “Light,” or similar descriptors for the above listed products and includes claims that the above products contain a reduced level of a substance, these products are modified risk tobacco products. Because these products are offered for sale to customers in the United States without an appropriate FDA order in effect under section 911(g) of the FD&C Act (21 U.S.C. 387k(g)), these products are adulterated under section 902(8) of the FD&C Act (21 U.S.C. 387b(8)).

First of all I don’t smoke. To each his own I say.
I am trying to help someone find a place to buy cigarettes relatively inexpensive. I was asked (repeatdly) to look into this for them so I told them I would check the internet with my favorite website City Data.

This thread is not to start any smoking debates, so please reply only if you have a thrifty way to purchase cigarettes.

Long story short, these are for a few Senior Citizens on a fixed income. There is no chance in hell that they will quit smoking. I can’t force them and I don’t want to make them miserable in their last years of life. Over the age of 70 and stubborn as a mules, after many arguments, I say give them what they want & let them be happy. Also, I am not looking to make any profit. I don’t need to.

So, I heard a rumor that there is an Indian Reservation that sells cartons cheap. Is this legal? Is it a rumor? I don’t want to break the law.
Just thought I’d ask, asking can’t hurt.
If you are a smoker (NJ) , where do you get your carton of cigarettes?

Native American Reservations do sell cartons cheap they don t charge the fed and state taxes on the carton. Also if you know of anyone in the military you can buy them at the PX or BX (post or base exchange). That is probably the best place. She then discovered a way to purchase them online from overseas she had to buy five cartons at a time to get free shipping but she saved a fortune. We always wondered about the legality of those purchases but she never had any problems.

Another idea if you know someone in the carolinas, virginia, kentucky or TN you might get them to purchase them and ship them to you. Florida as well a carton of Marlboro here is around $27 $30 at walgreens. Another good option is to roll your own. Bulk tobacco, a rolling machine and papers enough for a carton will set you back about $28.00 and you only have to buy the machine (about $6.00) once. I think most smoke shops in general will have lower prices than say Wal mart. Another thing I know people have done is to buy the large cans of tobacco and papers and roll their own. I believe filters are also available for those people that do roll them. Also a plus, it makes them smoke less because it keeps their hands busy.

P.S. My mom is the same way. She has so many health problems, a few related to her mental health and nerves.
At this point, whatever makes her happy is ok with me. But, I do try to encourage her to smoke less because it doesn’t make sense to chain smoke when one is on a fixed income.
